These Terms of Service ("Terms") govern your use of the website located at apexhailanddent.com ("Site") and the paintless dent repair services provided by Apex Hail & Dent LLC ("Apex Hail & Dent," "we," "us," or "our"). By using our Site or engaging our services, you agree to these Terms.

1. Services

Apex Hail & Dent provides paintless dent repair (PDR), hail damage repair, and related services to individual vehicle owners, body shops, dealerships, and fleet operators. Our technicians travel to body shops, dealerships, fleet yards, or other agreed-upon service locations to perform the work.

2. Estimates & Quotes

All estimates and quotes are provided based on the vehicle inspection, photos, or description supplied by the customer. Final pricing may adjust after physical inspection if additional damage is discovered or the scope of work changes. Any change to the scope will be communicated to the customer and confirmed in writing before work continues.

3. Payment

Payment terms are agreed upon at the time of estimate acceptance. Accepted payment methods include credit card, debit card, ACH, and business check. Invoices are due upon completion of work unless other terms have been negotiated in writing. Overdue balances may accrue late fees or be sent to collection.

4. Insurance Claims

When repairs are being paid through an insurance claim, the vehicle owner remains responsible for payment if the insurance carrier does not pay the full estimated amount for any reason. Apex Hail & Dent will provide estimates and documentation to support your claim but is not a party to the insurance contract.

5. Deductible Assistance

Deductible assistance may be offered on qualifying insurance claims, subject to eligibility. Availability, terms, and amounts vary by claim and are subject to applicable state and federal laws. Contact us for details before making assumptions about deductible assistance for your claim.

6. Warranty

Apex Hail & Dent warrants that our paintless dent repair work will remain free from defects in workmanship for the lifetime of the vehicle so long as the vehicle remains in the possession of the original customer at the time of repair. This warranty does not cover:

• New damage caused by subsequent hail, collision, or impact
• Damage caused by improper aftermarket modifications
• Corrosion, paint failure, or defects unrelated to our work
• Repairs performed by another party on the same panel after our work

7. Customer Responsibilities

You agree to:

• Provide accurate information about your vehicle and the damage
• Remove personal items from the vehicle before service
• Grant access to the vehicle at the agreed service location and time
• Notify us promptly if the scope changes or if you wish to cancel
• Pay the invoice on the agreed terms

8. Cancellations & Rescheduling

You may cancel or reschedule an appointment at no charge with at least 24 hours' notice. Cancellations with less than 24 hours' notice may be subject to a cancellation fee to cover technician travel and scheduling costs.

9. SMS & Communications

By providing your phone number and opting in on our contact form, you consent to receive text messages from Apex Hail & Dent related to your quote, appointment, estimate, invoice, or ongoing job (transactional), or promotional and marketing messages if you have opted in separately. 10. Website Use

You agree not to:

• Use the Site for any unlawful purpose
• Attempt to gain unauthorized access to any portion of the Site or its systems
• Interfere with the operation of the Site or servers
• Scrape, harvest, or extract data from the Site without our written permission
• Copy, modify, or distribute Site content for commercial purposes without permission

11. Intellectual Property

All content on the Site — including text, logos, images, photographs, graphics, and the Site's design — is the property of Apex Hail & Dent LLC or its licensors and is protected by U.S. and international copyright and trademark laws. You may not use, reproduce, or distribute Site content without our written permission.

12. Disclaimers & Limitation of Liability

Our services are provided on an "as-is" basis to the extent permitted by law. To the maximum extent permitted by law, Apex Hail & Dent's total liability arising out of or related to the services shall not exceed the amount you paid for the specific service giving rise to the claim. We are not liable for indirect, consequential, incidental, or punitive damages.

13. Indemnification

You agree to indemnify and hold harmless Apex Hail & Dent LLC, its officers, employees, and contractors from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising out of your breach of these Terms, your misuse of the Site, or your negligence.

14. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Broward County, Florida.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Continued use of the Site or engagement of our services after changes constitutes acceptance of the updated Terms.
